Minimum Housing Standards for Queensland Rental Properties

Starting 1 September 2023, minimum housing standards will be enforced for new tenancies in Queensland. These standards will apply to all tenancies from 1 September 2024.

Minimum housing standards aim to ensure all Queensland rental properties are safe, secure, and functional. They provide tenants, residents, property managers, and owners with clear guidelines regarding the maintenance obligations for rental properties.

 

What Are Minimum Housing Standards?

Minimum housing standards specify that rental properties must:

  • Be weatherproof and structurally sound: Roofing and windows must prevent water from entering the premises. The building must be safe, with walls, ceilings, and roofs in good condition, not likely to collapse or be affected by significant dampness. Decks and stairs must also be safe and free from rot or defects.
  • Be in good repair: Fixtures and fittings, such as electrical appliances, must not pose a risk of injury through normal use.
  • Have functioning locks or latches: All external doors and windows accessible without a ladder must have functioning locks or latches to secure the premises against unauthorized entry.
  • Be free from vermin, damp, and mould: Properties must be free from vermin, damp, and mould, except in cases where these issues have been caused by the tenant.
  • Include curtains or other window coverings: Privacy coverings must be provided in rooms where tenants might reasonably expect privacy, such as bedrooms.
  • Have adequate plumbing and drainage: Properties must be connected to hot and cold water suitable for drinking, with proper plumbing and drainage.
  • Provide bathroom privacy: Bathrooms must offer privacy and have flushable toilets connected to a sewer, septic tank, or other waste disposal system.
  • Have a functioning cook-top: If a kitchen is provided, it must include a functioning cook-top.
  • Include necessary fixtures for a functional laundry: If laundry facilities are provided, they must have tap fixtures and adequate plumbing, although the tenant may provide their own washing machine or other white goods.

 

Compliance for Existing Tenants

From 1 September 2023, the minimum housing standards will apply to all new tenancy agreements, including renewals for existing tenants.

They are also responsible for issues arising from reasonable use of the property (e.g., a leaking shower or malfunctioning stove top).

  • Tenant Responsibility: If tenant actions cause mould, damp, or vermin (e.g., inadequate ventilation or attracting pests), the tenant must address and repair these issues.
